In a meeting at Texas A&M on Wednesday evening it was determined to go forward with the first Transgender Nondiscrimination Summit on July 23, 2009 (Thursday) at the Texas A&M campus in College Station. This will be a full day summit meeting and is free to all attendees. Specifics will be announced within the next few weeks. We do have a need to locate a volunteer to create a website for this summit. It needs to be a simple website with summit information and a registration form. Texas A&M Gay, Lesbian, Bisexual, and Transgender Resource Center will put a link on their official website to the Summit website link. Space is limited so register early; once we have the registration process in place (it will be announced). Here is our Mission Statement:

To invite interested parties at other universities to discuss what works and what does not work in getting the phrase “gender identity and expression” into their respective nondiscrimination statements. Also, discuss strategies on how to approach the inevitable barriers that always arise. This summit is not intended to be a protest, demonstration, or rally. We want to invite the other universities’ representatives to simply discuss strategic approaches towards social justice issues related to inclusion statements.

Once in a while, a writer coalesces many disparate threads into one coherent and powerful statement that you recognize immediately as something that will have an impact on society. This is one of those times, an essay that is a comprehensive, compassionate, and imminently rational argument for treating trans*people fairly, not by some blogger, but by the Commissioner of Human Rights for the EU. He points out a variety of legal and social difficulties suffered by trans*people, including marriage, medical “requirements,” name changes, healthcare, and job discrimination and harassment, then concludes powerfully:

There is no excuse for not immediately granting this community their full and unconditional human rights. Council of Europe Member States should take all necessary concrete action to ensure that transphobia is stopped and that transgender persons are no longer discriminated against in any field.

During missions to member states of the Council of Europe, I have been reminded of the on-going discrimination many face on account of their gender identity1. Transgender persons encounter severe problems in their daily lives as their identity is met with insensitivity, prejudice or outright rejection.

There have been some extremely brutal hate crimes against transgender persons. One case which received media attention was the murder in Portugal of a homeless, HIV-positive, Brazilian transgender woman, called Gisberta Salce Junior. She was tortured and raped by a group of young men, thrown into a well and left to die.

My discussions with non-governmental organisations defending the rights of transgender persons indicate that a number of such hate crimes go unreported – even in serious cases. One of the reasons appears to be a lack of trust in the police.

Some people seem to have a problem with the mere existence of human beings whose outer expression of their inner gender identity is not the same as their gender determined at birth. Aggression against transgender persons cannot however be excused as resulting from ignorance or lack of education. These attitudes cause serious harm to innocent and vulnerable people and must therefore be countered.

I have been struck by the lack of knowledge about the human rights issues at stake for transgender persons, even among political decision-makers. This is probably the reason why more has not been done to address transphobia and discrimination based on gender identity. The result is that individuals are discriminated against all over Europe, in areas such as as employment, health care and housing.

In a number of countries, the problem starts at the level of official recognition. Transgender persons who no longer identify with their birth gender, seek changes to their birth certificates, passports and other documents, but often encounter difficulties. This in turn leads to a number of very concrete problems in daily life when showing one’s ID papers – in the bank or the post office, when using a credit card, or crossing borders.

One well-publicised case related to Dr. Lydia Foy in Ireland who sought to have her legal gender changed from male to female on her birth certificate. After ten years of struggle, in 2007 the Irish High Court finally ruled that the State was in breach of Article 8 of the European Convention on Human Rights.

The European Court of Human Rights has ruled that States are required to recognise legally the gender change of post-operative transsexuals2. In one case, Christine Goodwin, a post-operative male to female transgender person, complained about sexual harassment in the workplace, discrimination in relation to contributions to the National Insurance system, and the fact that she was prevented from marrying a man (because she was still legally male).

The Court stated that “the very essence of the Convention was respect for human dignity and human freedom. Under Article 8 of the Convention in particular…protection was given to the personal sphere of each individual, including the right to establish details of their identity as human beings.”3

In some European countries, it has now become possible to correct offical records and obtain a new first name. However, in other countries a change of birth certificate is simply not allowed. In a large number of Council of Europe Member States, such changes are permitted only upon proof that the transgender person has been sterilised or declared infertile, or has undergone other medical procedures, such as gender reassignment surgery or hormone treatment. The individual’s sincere affirmation of their gender identity is not seen as sufficient, and the suitability of the medical procedures for the person in question is not considered.

Additionally, many countries require that a married person divorces before his or her new gender can be recognised, even though the couple itself does not want to divorce. This in turn may have an impact on children of the marriage. In fact, in several countries the parent who has undergone the gender change will lose custody rights. Legislation requiring divorce needs to be reformed in the spirit of the best interests of the child.

To require surgery as a prerequisite to enjoy legal recognition of one’s gender identity ignores the fact that such operations are not always desired, medically possible, available, and affordable (without public or other funding). It is estimated that only 10% of transgender persons in Europe actually undergo gender reassignment surgery.

Even access to ordinary health care is a problem for transgender people. The lack of trained staff familiar with the specific health care needs of transgender persons – or simply prejudice towards transgender people – render them vulnerable to unpredictable and sometimes hostile reactions.

In the United Kingdom, male to female transgender persons have been struggling to get their gender status accepted for the purpose of pension benefits. In spite of overwhelming legal arguments they have so far been denied the pension rights that other women in the country (who were born female) enjoy without question.

There are other obstacles encountered in day-to-day life. A major problem for transgender persons is harassment and discrimination at work. Some leave their jobs to avoid it, while others avoid gender reassignment surgery for fear of stigmatisation.

Data presented by EU’s Fundamental Rights Agency shows that in some countries the unemployment rate of transgender persons can reach up to 50%. Some jobless transgender persons are unable to find employment, and see no other option but to work in the sex industry. A report from Human Rights Watch on Turkey called attention to the situation of transgender sex workers in that country – victimised by violence, drug addiction, sexual abuse, lack of health insurance, homelessness, police attacks, and a high risk of HIV/AIDS.

To date, very little factual information is available on the situation of transgender people in Council of Europe Member States. This information is needed urgently to determine the extent of the problems faced.

There is no excuse for not immediately granting this community their full and unconditional human rights. Council of Europe Member States should take all necessary concrete action to ensure that transphobia is stopped and that transgender persons are no longer discriminated against in any field.

If you weren’t looking for it, you might have completely missed language on the Obama transition website (Change.Gov) pledging not to discriminate on the basis of gender identity, among other things. On the page regarding those who seek appointments to this administration, you’ll find the following language:

The Obama-Biden Transition Project does not discriminate on the basis of race, color, religion, sex, age, national origin, veteran status, sexual orientation, gender identity, disability, or any other basis of discrimination prohibited by law. (emphasis added)

According to employment lawyer Daniel Schwartz, who was quoted in an NPR report, gender identity nondiscrimination has never been part of federal hiring policies before, and expects that this pledge by Obama will form the basis of an executive order when the new administration starts. The ACLU issued a statement praising this language, as well.

If you’ve read this blog for a while, you know how highly I think of my friend Allyson Robinson. I knew she was a finalist for this high-visibility position for the last month or two, but today she was officially named Associate Director of Diversity for the HRC (Human Rights Campaign). She’s a great thinker and communicator and this position certainly calls for those skills. Many GLBT activists are still awfully angry at the HRC for supporting an Employment Non Discrimination Act (ENDA) last fall that did not include transgender people, and many of these same people see Allyson’s hiring as a Machiavellian move by the HRC to smooth over the hard feelings.

And maybe it is.

But knowing how patient and intelligent and loving and savvy Allyson is, I think that being the first transwoman ever hired by the HRC — being inside the biggest Washington lobby for GLBT issues — is a mighty impressive step, and bears attention.

WASHINGTON–The Human Rights Campaign Foundation, the nation’s largest gay, lesbian, bisexual and transgender civil rights group, today announced that Allyson Robinson has been named Associate Director of Diversity of the organization. Robinson, a longtime activist and ordained minister, will lead HRC and its volunteer base in promoting awareness of transgender issues and ensuring that all program areas demonstrate measurable commitment to transgender equality and inclusion.

“I am delighted that Allyson Robinson has joined the HRC team and I am eager to begin the hard work of educating the public and our elected officials about transgender issues with her,” said HRC President Joe Solmonese. “Allyson’s background of facilitating communication and fostering meaningful relationships make her the ideal person to fill this crucially important role.”

“Advocacy to me means being a voice for the voiceless by ensuring their perspectives are heard and their needs fully considered,” said Allyson Robinson, the new HRC Associate Director of Diversity. “I’m grateful for the opportunity to join HRC at this crucial moment in its support of full inclusion for the transgender community, and look forward to working with HRC Steering Committees and in partnership with other fair-minded and LGBT-inclusive organizations to lead that effort nationally.”

Allyson is a 1994 graduate of the United States Military Academy at West Point, where she majored in physics. She received her Master of Divinity degree in theology, with a capstone emphasis in Social Justice, from Baylor University’s George W. Truett Theological Seminary in 2007. Prior to her transition, she pastored congregations on two continents for nine years.

Robinson’s hiring has been applauded by leaders of the transgender community.

“Allyson is a committed activist for trans people and the people who love them,” said best-selling author Jenny Boylan. “A lot of work needs to be done to mend fences between HRC and the trans community, and Allyson, by dint of her dedication, compassion, and articulate insight, is the one to do it. I am sure her wisdom, poise, and humor will do well for all the members of our community, and I wish her all the best.”

“Allyson is a great addition, and as someone who works closely with HRC nationally and locally, I’m delighted to add her energy to expand the quantity, quality and awareness of fully inclusive workplaces and to support our diversity initiatives in Boston,” said HRC Business Council and Steering Committee member Diego Sanchez.

“Allyson comes to the position with my full support. Her ministerial teachings and learning, combined with her West Point training will be a great asset to HRC and the LGBT community where she will be able to listen to hearts and emotions of all people”, said Meghan Stabler, HRC Business Council and HRC Houston Steering Committee member. Stabler continued, “As a transgender person, she will be able to educate internally within HRC and externally with the community and allies on key issues, including HRC’s call for an inclusive ENDA.”

Robinson was selected to be Associate Director of Diversity following a four-month national search.
